Willie Revillame’s camp files new motion to halt hearing on ABS-CBN’s copyright infringement case

The camp of Willie Revillame has filed a new motion that might delay the court proceeding on the P127 million copyright infringement suit charged against them by ABS-CBN. The counsels of defendants Revillame, Wil Productions, ABC 5 (also known as TV5), and ABC 5 President Ray Espinosa informed Branch 66 of the Makati Regional Trial Court yesterday (Dec 7) that they have filed a petition for certiorari or prohibition at the Court of Appeals, in the hope of preventing the trial court from continuing the hearing on ABS-CBN’s application for a temporary restraining order (TRO) against the TV5 program “Willing Willie.” The defense lawyers cited the Makati RTC’s alleged grave abuse of discretion after presiding Judge Joselito Villarosa has repeatedly denied or deferred its rulings on the motions they submitted. They added that as "judicial courtesy," the Makati RTC should first wait for the decision of the Court of Appeals on the petition before moving forward with the TRO hearing.

Court hears TRO application of ABS-CBN against TV5’s Willing Willie

The Regional Trial Court of Makati City ruled today (Dec 2) to continue hearing ABS-CBN’s application for a temporary restraining order (TRO) against TV5 program “Willing-Willie,” allegedly a copycat of ABS-CBN noontime show “Wowowee.” Judge Joselito Villarosa of Branch 66 of the Makati RTC, decided to push through with ABS-CBN’s presentation of evidence for a possible TRO amid motions raised by the defendants, including a motion to dismiss the case, a motion for Villarosa's inhibition as presiding judge, a motion to defer the TRO hearings, and another motion requesting to drop TV5 President Ray Espinosa as one of the defendants. Villarosa told both parties that he will decide on the various motions filed by the defense before he rules on the TRO application. Atty. Bienvenido Somera, who is representing ABS-CBN, argued that there should be no delay in the TRO application proceedings since the Supreme Court has ruled that the filing of a motion to dismiss is not a ground
